The Chair (Réjean Bélanger) is asking why the CBSA agency removed information from documents that Davis only received with ‘the information act’. Sean Gaudet is stuttering, waving his hand about, and explaining why it is ok for CBSA to withhold, tamper with, and even lose information. The Chair (Réjean Bélanger) said he is making a note of Sean Gaudet’s comments and Sean is looking towards his right in disgust.

3:15 pm, Helene is responding to a question about why a map of Akwesasne was put up by the men’s washroom. She said that CBSA did not explain why the map was up or why it was put up where it was.

Helene is answering Mr. Brian Smith’s questions about a two day aboriginal awareness session, during the time that she was a CBSA officer. She is talking about how she was dropped off at Jazz Magnolia in Cornwall Ontario for the aboriginal awareness session. She said she was sent home, after she pointed out misinformation, and the session continued to be provided to the rest of the CBSA officers.

3:28 pm, The Chair just asked Sean Gaudet if he will be done questioning Helene Oakes by 4:00 pm and everyone laughed. Sean is asking Helene for her birthday and her maiden name. She asked Sean Gaudet to explain how her maiden name is relevant, but answered anyway.

Sean is asking Helene about her marriage experience now. Helene questioned the relevance of her marriage experience. Sean Gaudet is asking if Helene’s husband took Helene’s oath yesterday, what is Helene’s husband’s connection with Akwesasne, and the marriage history of Helene and her husband.

The Chair told Sean Gaudet to move on. Sean just told Helene that she started as a clerk and Helene told Sean that she started as a secretary 2. Helene said she became a CBSA officer (BSO) in February 1999. Sean is asking Helene what her past career experience was with CBSA. August 2003, Helene became customs officer, after 3 months training in rideaux, and it included a diversity training (with jelly beans).

Sean Gaudet is asking Helene to verify all her previous statements. Helene is stating that she is not an expert on the Mohawk culture or community, and she considers herself a member of the Mohawk community. Helene is asking Sean Gaudet how the question is relevant to Fallan Davis? Sean Gaudet objected and the Chair is explaining that it sounds like Helene is trying to understand Sean Gaudet’s question.

Sean is saying that he just wants to know when the witness started feeling like she was a member of the Mohawk community. Helene stated “5 pm last night” very sternly. Sean is asking for the reason that Helene considers herself to be a member of the Mohawk community, does she live in the Akwesasne community, and has she ever lived in the Akwesasne community. Helene said “How is that relevant to this case’? The Chair is explaining to Sean Gaudet that he needs to explain why he is asking the questions.

Sean is explaining that he wants Helene to explain how she knows anything about the Akwesasne community. Sean Gaudet is telling the Chair that the evidence provided by the witness, is fabricated and he wants to expose her, by establishing background facts about the witness.

Sean is referring to a document that he never showed the Davis team, that he does not want to submit into evidence, but he wants to use it to prove that Helene is an incompetent liar? I am absolutely confused about why they are allowing Sean Gaudet to use documents that were never shown to Davis, even though Sean has absolutely objected to allowing Davis to use or submit evidence regarding how Lucinda Reading proves that CBSA maliciously destroyed or lost the audio video recordings from the Davis incident.

3:57 pm, Sean Gaudet is running Helene Oakes through his usual character assassination routine now.

4:02 pm, Sean Gaudet is insinuating that CBSA officers are trained to dance and pose in front of cameras, as part of a diffusion / confusion technique?

4:03 pm, Teiohontathe Fallan Davis is asking the Chair if he can help to get the tape, because CBSA is hiding the tape. The Chair wants to know why the audio video recordings from the Davis incident disappeared, who made the tapes disappear, and why did the tapes disappear?

Sean Gaudet is stating that CBSA will provide evidence… The Chair just said to Sean Gaudet again, ‘How come you don’t have the tapes’? Sean Gaudet is stating that he heard the Chair would keep an open mind and base his decision on the evidence provided.

Fallan Davis, also wants to note that the tape was asked for, and that CBSA responded with a written statement that said they never had any tapes and that CBSA never even signed the response.

Sean is asking the Tribunal to stop early again. Fallan is reminding Sean Gaudet that he previously agreed to go on until 5 pm each day. Sean Gaudet stated that he has to leave early, because he has another meeting that involves this Davis case. The Chair is allowing the Tribunal to end early at 4:45 pm again.

4:12 pm, everyone just went on a short break. Lucinda Reading is laughing with her assistant.

4:18 pm, everyone just returned from break. Sean Gaudet is asking Helene Oakes to describe how she questioned anyone and what kind of documents would she accept from anyone that went into the Indian Lane of the old CBSA checkpoint that was on Kawehno:ke (cornwall island, ontario) , at the time of the Davis incident in 2005. Helene is explaining that sometimes CBSA officers did not check identification from travelers that they recognized, based on each specific traveler, and each specific individual circumstance, of each individual that went through the Indian Lane from 1998 to 2008.

4:37 pm, Fallan Davis just noticed that the document that Sean Gaudet is referring to, is dated 2007 and that is not relevant because the Davis incident happened in 2005.

4:40 pm, Sean Gaudet is now referring Helene Oakes to the Akwesasne Remission Order. Helene is explaining how she was trained about the Remissions Order. She said that she was given a piece of paper with 5 questions on it and told to use that when questioning the Mohawks.

Helene is saying that the Remission Order is to respect the Jay Treaty, so that the Mohawks can bring goods to their reserve and use the goods on their reserve, while not being charged taxes.

Sean is now asking Helene to confirm the specific details about the Akwesasne Remission Order. Teiohontathe Fallan Davis just objected to Sean Gaudet’s use of the document, because it is from the Internet and not signed by the Mohawk Council. The Chair is stating that he is satisfied with the document. Sean said thanks to the chair and is asking Helene Oakes if she is familiar with the Remission Order again.

This past summer, we had more than 8 various police, border, and military agencies threatening to arrest Onkwehonwe that questioned why they were being stopped from traveling freely from their homes, schools, and businesses around Akwesasne.  Readers can search this website, to find the details about the daily harassment that Onkwehonwe endure from surrounding police, border agents, and military groups.

As a result of the uncertainty of our safety around Akwesasne, many Onkwehonwe are learning journalism, internet marketing, videography, vlogging, and various new skills, with hopes of helping to keep themselves and loved ones safer around Akwesasne.  The bullies that threaten us in the past and the present, seem to behave a little safer when they realize they are being recorded and their behavior can be seen live on the Internet.  Unfortunately, some of the worse bullies’ best behavior is still quite unstable and dangerous for Onkwehonwe.

Most of our local stores around Akwesasne are selling out of the recorders that I recommend, every single week.  The easiest ones for newbies, are recorders that can be plugged into a computer USB drive.  The audio and video files are then quickly and easily uploaded to the Internet.

This week, I found a tiny gadget that can record audio and video.  It is tiny enough to keep on your wrist, on your shirt lapel, clipped to your purse, bag, your car, your bicycle, or pretty much anything else you can imagine.  Velcro strips are typically added to tiny recording devices to keep them securely in place. Here is a promising video audio recorder that costs less than $30.00. Remember to practice with your recording gadgets before you leave your house, so that you are not fumbling with buttons, if you find yourself in a crisis situation. Often, a visible camera is enough incentive to help stop bullies from trying to harass travelers.

On November 3rd 2009, I was surprised to see that CJOH TV (Max Keeping) was showing a video that I created, on his televised news report.  I was surprised because I am positive that a news station is aware of their own copyright laws.  CJOH TV showed my video on 3 of their televised news shows and they sell copies of that on their website.

A few reporters have asked me for permission to use my photographs, video, and to interview me about the recent events that I was involved in, around Akwesasne.  I told every reporter that I do NOT give them permission to use any of my photographs, video, or stories for any reason.  So, you can imagine my shock when I saw my video being used to promote CJOH TV.

I don’t usually bother to complain when I see another using any of my media, as long as they are decent enough to give me credit and link to my own website or contact information.  So, I decided to find out if CJOH TV just assumed they would compensate me for my work, when I contacted them.  All reputable media companies are accustomed to compensating those that create the media, right?  I assumed that they knew that I never agreed to provide any type of slave labor, charity, or favors for their benefit – while I lose as a result of their actions against me.

All of my contact information is on all of my videos, photos, and stories, yet not a single person had ever attempted to contact me from CJOH TV, as of Thursday morning November 5th, 2009.  On CJOH TV, when Max Keeping showed my video, they covered up the bottom portion of my video, where my contact info is typically shown.  CJOH TV and Max Keeping did not even have the decency to give credit to the video creator (me).

Today, Thursday afternoon October 5th 2009, I decided to contact CJOH TV, to let them know that I am the video creator and that they never contacted me to request that they can use my work for any of their benefit.  I planned to let them know that like all videographers, reporters, and freelancers, I am compensated and credited for my work and that they were causing undue financial loss to me, as a result of their actions.

I phoned CJOH TV at (613) 224-1313 and the operator said she was surprised that CJOH TV would use my video on the televised news and sell it on their website, without asking for my permission first.  She told me to phone Scott Hannant (a news director for CTV Ottawa) at (613) 274-4347 and that he would be most interested in correcting the situation.  I phoned that number and a man named Paul from the news room, became angry with me and tried to start interviewing me about the incident on the video.

I told Paul that I am not contacting him to be interviewed and we need to correct the situation of how CJOH TV is using my video – while never asking for my permission.  Paul finally gave me the direct phone number to Scott Hannant, the news director for CJOH TV (613) 274-4336.  I left a short voice message on Scott Hannant’s direct line and he finally phoned me back at 1:56 pm.

Scott Hannant insisted that CJOH TV has a right to use anyone’s video without their permission.  I reminded Scott that this whole situation was silly and that we have many local photographers, videographers, and reporters in Akwesasne that are happy to help CJOH TV get the stories about our own local community.  Scott responded that he would never agree to compensate any freelancers or reporters from Akwesasne for their work, because he would rather compensate his own Union of workers in Ottawa.

I was surprised again that yet another employee of CJOH TV, behaving as if it’s normal to  blatantly steal from anyone in Akwesasne – then earn a profit from that very theft.  Why is it normal to compensate and credit anyone else, as long as they are not from Akwesasne?

CJOH TV has been selling copies of any of their televised news (including the ones with my video) for $60.00 per copy.  It’s difficult for me witness CJOH TV, make excuses for earning profits from media created by Onkwehonwe freelancer, and even intentionally try to block Onkwehonwe freelancers, from benefiting from their own labor.

Scott continued to make one excuse after another.  Scott stated that it is a common practice of  CJOH TV,  to  use video on their televised broadcasts and the internet, without notifying, without asking permission, without providing credit to the video creator, and without compensating the video creators, as long as it is only 30 seconds of video.

Scott also went on to state that he does not understand how to find the copyright owner of videos on YouTube.  I gave him some basic instructions on how to read the Copyright Policies on Youtube and how to look at my video where it’s embedded and states ‘Copyright Monica Peters. All Rights Reserved’.

So, then Scott,  stated that he received my video, with the copyright removed, from an R.C.M.P. officer named Michael Harvey and to just contact Michael Harvey to pursue the Copyright Violation, by email at michael.harvey@rcmp-grc.gc.ca.  Sounds like Scott just wants to blame someone else, anyone else.

Scott angrily rambled one excuse after another about how he only compensates his own special group of Union workers and will never agree to give credit to me for my work, he will never agree to discuss working with anyone from Akwesasne either.

Scott demanded that I give him my email address so that he could have his lawyer contact me.  I asked Scott to give me his lawyer’s contact information on the phone, but he declined. I did my best to keep him calm and the discussion friendly, but even my patience wore thin from his ugly excuses, so I ended the conversation.

I guess I am sheltered here in Akwesasne, where our close-knit community tends to circle around each other during times of trauma and crisis.  Even as the government agents, C.B.S.A. union agents, U.S.A. Border Agents, NY State Troopers, Cornwall Police, Massena Police, R.C.M.P., Ontario Police threaten to block our roads / bridges,  silence us, herd us into our ‘reservation’, silence us, publish their own twisted stories about us, and do whatever they can to cause distress to us, I had actually forgotten that even more corporations and unions have such detest for anyone in Akwesasne.

So now my Onkwehonwe friends and family can know how and why CJOH TV, stole from yet another Onkwehonwe Akwesasneron.  I know, I know, this is nothing surprising or shocking and Yes, You did Tell Me So.
